The adversarial way and the alternatives

iStock_000005502207_ExtraSmallThe adversarial process has disadvantages.

  • Someone has to lose
  • The possible remedies for the winner are usually very limited
  • It tends to take a long time ( months or years) which is a problem for a student or employee and expensive in management time for the institution.
  • It can damage relationships between student and institution or between employees so badly that they cannot be repaired.
  • Alternative methods of dispute resolution can be quicker and much less damaging, as well as cheaper. They can also offer a wider range of solutions.
